Cultural and Industrial Heritage: a link Urgent! Grave
On July 22 the President of the Republic, Alan Garcia signed the Law 29,565, Law establishing the Ministry of Culture.
This law comprises 20 articles, 4 Transitional and Supplementary Provisions Supplementary Provisions Final 11.
Within the latter, the Act has included provisions in the sixth, seventh and eighth, the figure of the Cultural Promotion and Cultural Patronage. The 6 th
provision refers to the Grant for cultural projects, the 7 th. Deduction of expenditure on donations and the 8 th. Application mentioned deductions.
But what is the cultural promotion Law 29565?. In short, cultural promotion and cultural patronage, as it was known by the media, is that the amount donated to the realization of a cultural project, the donor may deduct the amount as an expense, for the payment of income tax.
Any natural or legal person, public or private, obviously pays taxes to the SUNAT, may be a potential donor. The donation must be solely in cash and the total amount or part of the cultural project that seeks to promote. Also, a project can be funded by more than one donor. Donors can deduct as an expense to one hundred percent (100%) of the amount donated, provided that such deduction not exceed 15% of the net income of third category. Since 2014, the ceiling is 10%.
addition, the law states in general terms the features that projects would have to be considered eligible under this scheme. Fortunately, these requirements would be allowed to list an extensive list of cultural projects. And in regard to projects related to the Industrial Heritage proyectyos able to carry out conservation, restoration and promotion of this heritage.
